BBC to deduct employee and employer NI for freelancers - can this be legal?

The BBC announced today that freelancers who are outside IR35 (i.e. casual staff) will have to pay both their own tax and NI, as well as the BBC's employer NI - through a corresponding reduction in rate.

"We’ll reduce your rate to cover the Employer National Insurance. The BBC will pay the Employer NI on top of your rate, taking the rate back to the original level"

Can this even be legal - employer NI is for the employer to pay.
